August 8th, 2016. FDA Deeming Regulations and What Does it Mean to You?

As of August 8th, 2016, the Food and Drug Administration will officially deem vapor products as "Tobacco Products" under the Family Smoking Prevention and Tobacco Control Act.  What does this mean for the millions of vapers out there and those who have enjoyed MVG's services?

The bad news is that on August 8th, the countdown starts to what is essentially a vaping 'prohibition.'  Any vaping products not on the market prior to February 15, 2007, will be eliminated from the market.  This means that 99% of the products you know and enjoy (and 100% of the products within our shop), will disappear in 2 years unless the grandfather date is changed.

The language in the regulations is 'all encompassing' and will deem 0mg products, wick & wire, and even batteries as 'Tobacco Products.'  The FDA has taken a guilty by association approach, and if something can be utilized with an e-cig product, it WILL be considered a tobacco product.

The regulations also impact how vapers have been used to shopping for new products.

So what happens after August 8th, 2016?

Age Verification

We have instituted an automated verification process which helps us verify a majority of our customers.  In the event that we cannot automatically verify your age, you may be asked to manually verify your age through our verification form.  If you'd like to avoid any delays, you can manually verify yourself ahead of time here.

No Free Sampling

Free samples are now a thing of the past. If you would like to taste a new flavor at a vape shop, expect to be charged a 'tasting fee' for your juice.

No New Products

There is a market freeze on existing vapor products, and no new products will be allowed to enter the US market without pre-market approval by the FDA.  The pre-market approval is estimated to cost $1 million dollars per product sku, and even slight changes (e.g. changing a mod's screw to a better screw) will be considered a new product.  All products will be frozen and sold as-is.  These products, however, will disappear on August 8th, 2018 unless the vaping community can create change.


The Good News

The team at My Vaping Goodies is dedicated to offering these goods through the regulation period.  There are specific items and registrations we need to handle with the FDA in order to stay in business, however, we are complying with these changes and are optimistic about the future.  There are a couple of bills that require your attention to help move things in our favor--HR2058 and the Cole-Bishop Amendment.

Support the cause and visit August8th.org to help take action. Press the issue. Continue to spread positive articles, stories, and messages about how vaping has helped you. It’s easy, something you can do in front of the CPU, and it doesn’t take more than a few minutes. HR2058 isn’t THE solution, but it is A solution to help us as the industry continues to fight to get a real solution in place.

With everything said about August 8th so far, please don't freak out.  We have a strong community and plenty of optimism that things will work out in the end.  We are helping with the advocacy efforts and hope that our loyal MVG community can provide additional support.
